		January 28, 2005. Court Reporter SANDRA CORPE, Assistant
		Prosecutor JEVNE MEADER, MICHAEL S. KATZ on behalf of the
		Defendant, and Defendant DAVID P KLOTZ present in court.

		Defendant, in open Court, withdrew previous plea of not
		guilty, orally and in writing, waived all constitutional
		rights, and entered plea of NO CONTEST to the offense of
		Theft, count 1, in violation of R.C. 2913.02(A)(3) and
		(B)(2), a felony of the 5TH degree.

		Plea accepted. Defendant found guilty. Written plea and
		journal entry ordered filed.

		Defendant and State waived any rights to a presentence
		investigation and report. Matter proceeded to sentence.

		Pursuant to Crim. R. 32, all individuals afforded
		opportunity to be heard. Sentencing hearing held pursuant
		to R.C. 2929.19. Court considered the record, oral
		statements, any victim impact statement, as well as
		principles and purposes of sentencing under R.C. 2929.11
		balancing seriousness and recidivism factors under R.C.
		2929.12.

		The Court further finds pursuant to R.C. 2929.13(B) that
		defendant served a previous prison term.

		Court found prison sentence consistent with the purposes of
		R.C. 2929.11, defendant not amenable to community control.

		Defendant ordered to serve 7 months in Ohio Department of
		Rehabilitation and Corrections. This sentence, in count 1,
		is ORDERED to be served concurrently to the time Defendant
		is presently serving.

		Defendant granted credit for -0- days up to and including
		this sentencing date and granted credit for all additional
		in-custody days while awaiting transportation to the
		appropriate institution.

		At the request of the State of Ohio and for good cause,
		nolle prosequi is entered as to count 2.

		Defendant found to have, or reasonable may be expected to
		have, the means to pay restitution and all or part of the
		applicable costs of supervision, confinement, assigned
		counsel, and prosecution as authorized by law. Defendant
		ordered to reimburse the State of Ohio and Lucas County for
		such costs and to pay restitution in the amount of $850.00
		to A. Bugrenc, and $700.00 to American Legion Post #531, for
		a total restitution amount of $1,550.00. This order of
		reimbursement and restitution is a judgment enforceable
		pursuant to law by the parties in whose favor it is entered.
		Defendant further ordered to pay the cost assessed pursuant
		to R.C. 9.92(C). Notification pursuant to R.C. 2947.23
		given.

		Defendant ordered remanded into custody of Lucas County
		Sheriff for immediate transportation to appropriate state
		institution.
