Defendant, in open Court, withdrew previous plea of not
guilty, orally and in writing, waived all constitutional
rights, and entered plea of No Contest to lesser
included offense of Assault, count of the indcitment in
violation of R.C. 2903.13(A)&(C) a misdemeanor of the 1st
degree, Assault, count 2 of the indictment in violation
of R.C. 2903.13(A)&(C) a misdemeanor of the 1st degree.
Plea accepted. Defendant found guilty. Written plea and
journal entry ordered filed.
Defendant and State waived any rights to a presentence
investigation and report. Matter proceeded to sentence.
Pursuant to Crim. R. 32, all individuals afforded
opportunity to be heard. Defendant committed to the
Corrections Center of Northwest Ohio for 180 days as to
count 1 and 180 days as to count 2 until released
according to law.
Defendant granted credit for -0- days up to and including
this sentencing date and granted credit for all
additional in custody days while awaiting transportation
to appropriate institution.
Imposition of incarceration portion of sentence ordered
suspended. Defendant probated to Lucas County Adult
Probation Department for 1 year conditioned upon
compliance with the rules and regulations of the Lucas
County Adult Probation Department, with special added
conditions: 1) Defendant to serve community service of
120 hours. Court would like defendant to speak to young
people about what is requiredas a football player.; 2)
Defendant to ingest no illicit drugs, alcohol and/or
prescription medication not lawfully prescribed to
defendant ; 3) Defendant to submit to random
urinalysis; 4) Transfer probation to DeKalb, Illinois.
Defendant notified that under federal law 18 USC 922(g)
and state law, as a result of a felony conviction or a
misdemeanor offense of violence conviction against a
family or household member, defendant shall never be able
to ship, use, receive, purchase, own, transport, or
otherwise possess a firearm or ammunition and violation
is punishable as a felony offense.
Defendant found to have, or reasonably may be expected to
have, the means to pay all or part of the applicable
costs of supervision, confinement, assigned counsel, and
prosecution as authorized by law. Defendant ordered to
reimburse the State of Ohio and Lucas County for such
costs and to pay restitution in the amount of $889.45 to
Carolyn Hiner. This order of reimbursement and
restitution is a judgment enforceable pursuant to law by
the parties in whose favor it is entered. Defendant
further ordered to pay the cost assessed pursuant to R.C.
9.92(C), 2929.18 and 2951.021. Notification pursuant to
R.C. 2947.23 given.
