waived prosecution by indictment as to Count Six and Count

Defendant entered a plea of Guilty to the offense of
INVOLUNTARY MANSLAUGHTER, in violation of Revised Code
Section 2903.04(A) & (C), a Felony of the 1st degree, as
charged in Count Six of the Information; and entered a
plea of Guilty to the offense of INVOLUNTARY MANSLAUGHTER,
in violation of Revised Code Section 2903.04(A) & (C), a
Felony of the 1st degree, as charged in Count Seven of the
Information. Further, defendant entered a plea of Guilty
to the offense of AGGRAVATED ARSON, in violation of
Revised Code Section 2909.02(A)(1), a Felony of the 1st
degree, as charged in Count Four of the Indictment.
Defendant notified of five (5) years mandatory post
release control as to Counts Four, Six, and Seven.
Defendant given Explanation of Duties to Register as an
Arson Offender pursuant to O.R.C. 2909.14, as to Count
Four. The Court finds the pleas were made knowingly,
voluntarily and with an understanding of each charge, the
maximum penalty involved and the effect of the plea. The
defendant and the State of Ohio and the Court agreed prior
to the plea that the Defendant would accept and be
sentenced to a 15 year term of state incarceration. Pleas
accepted and ordered filed and pursuant to statements made
by the Defendant and the State of Ohio, finding of guilt
made.
Defendant having waived her rights to a presentence
investigation and report the
sentencing hearing was held pursuant to R.C. 2929.19.
Defendant was afforded all rights pursuant to Crim.R. 32.
The Court has considered the record, oral statements, and
any victim impact statement, as well as the principles and
purposes of sentencing under R.C. 2929.11, and
has balanced the seriousness, recidivism and other
relevant factors under R.C. 2929.12, in accord with the
agreed upon sentence by and between the parties:
It is ORDERED that defendant serve a term of eight (8)
years in prison as to Count Four. It is ORDERED that
defendant serve a term of 11 years in prison as to Count
Six as to Olandia Dixon.
It is ORDERED that defendant serve a term of four (4)
years in prison as to Count Seven as to Robert McGhee.
The sentence in Count Four is ordered to be served
concurrently with the sentences in Count Six and Count
Seven, as the Court finds Count Four merges with Count Six
and Count Seven. Being necessary to fulfill the purposes
of R.C. 2929.11, and not disproportionate to the
seriousness of the offender's conduct or the danger the
offender poses, the Court further finds the harm caused
was great or unusual, therefore the sentences in Count Six
and Count Seven are ordered to be served consecutively.
Defendant ordered to serve a total incarceration of 15
years, which was the agreed upon sentence between the
State of Ohio and the defendant.
Defendant notified she may be eligible to earn days of
credit under the circumstances specified in R.C. 2967.193,
and that these days of credit are not automatic, but must
be earned in the manner provided for in R.C. 2967.193.
The aggregate days of credit under this section shall not
exceed 8% of the total number of days of the stated prison
term.
It is further ORDERED the defendant is subject to 5 years
mandatory post-release control as to count Four, Six, and

Defendant Kenya McGhee has again requested this Court
grant her judicial release by way of a Motion for Judicial
Release filed by counsel on March 25, 2021.
This Court has reviewed the contents of the most recent
motion filed on defendant's behalf, and further reviewed
correspondence written by the defendant and addressed to
this Court, along with a packet of information documenting
inmate McGhee's progress and accomplishments while at the
institution.
This Court also reviewed a post-sentence investigation
report conducted by the Lucas County Pre-trial Pre-
Sentence Department, as well as a post-sentence mental
health assessment ordered by the Court and completed by
Court Diagnostic and Treatment Center clinical
psychologist Dr. Cassel.
Defendant McGhee was sentenced to a total term of
incarceration of 15 years as a result of a negotiated
resolution, being an agreed-upon sentence on her part and
the State of Ohio, regarding her participation in conduct
which resulted in the death of two people along with the
destruction by fire of a multi-unit apartment building.
Also reviewed where past letters to the Court by the
defendant and her paraphrased recounting as to what this
Court said regarding future consideration of a motion for
judicial release. This Court has further reviewed its
statements to defendant made at the time of the acceptance
of her plea and sentencing.
When discussing defendant's eligibility to file for
Judicial Release, this Court advised defendant that the
earliest she could do so was after serving 1/2 of the
agreed-upon 15 year sentence. Further, the record in this
case reflects the following exchanges:
The Court: Further, I, as the sentencing judge, I have
not agreed to let you out in seven and a half years years.
All right. And you should not think that I have agreed.
The most, I told your attorney, is that I'll keep an open
mind. I'm going to look at your conduct as to how you
conduct yourself in the institution. Additionally, I want
some more information about you. So even though it's my
intention to sentence you here today, I'm going to order a
presentence psychological - - well, it will be a post-
sentence psychological evaluation about you and a
sentencing report about more of the details about this
offense. So that if and when you do file that motion, any
court will have enough information to make an informed
decision. Do you understand that as well?
The Defendant: Yes.
The Court: So one more time. Don't think you're getting
out in seven and a half years because only the judge will
make that determination. And I have not agreed to that.
But I'll keep an open mind when we get to that point. Do
you understand that as well?
The Defendant: Yes,sir. Yes,sir.
During the sentencing phase of the preceding's the Court
expressed as follows: "And I will say to the family, I in
no way have indicated to either the counsel for the State
or the defense counsel or the defendant and I'm going to
be granting judicial release. I said I will keep an open
mind about it. And that's what I will do. It will be
dependent upon the additional information that I have
requested in terms of the report and the psychological
report. It's going to matter how you conduct yourself
while you're in the institution. And finally, it will be a
matter of whether I feel that you have paid a high enough
consequence for the two deaths that you were involved in.
So we'll see what happens if and when she applies. That's
pretty far down the road, and we'll look at it at that
time."
To defendant McGhee's credit, and though the
institutional report summary reveals a fight which she was
involved in in 2018 and occurrences of disrespectful
verbal interactions with Correctional Officers, more
recent evaluations described McGhee as "a model inmate",
shows "great leadership and respect for others", displays
"good team building skills", and in an inmate evaluation
report dated 2/11/2021 is assessed as follows: "she is
dependable while attending to her job assignments, follows
directives without question, maintains proper cell
appearance, is compliant with the property limit policy at
Dayton Correctional, and has an excellent disciplinary
history with zero contact reports issued in over two
years. Quite the role model for the general population at
DCI."
All of this information is precisely what the Court wants
to see when looking to grant a defendant's motion for
judicial release.
On the other side of the scale are the following
circumstances. One of which is the assessment of the post
plea psychological evaluation which summary and
recommendation reads as follows:
"Ms. McGhee is facing time in prison because of her
conviction on charges of aggravated arson and involuntary

manslaughter (times two). She was the victim of physical
and sexual abuse as a child. She has been treated for
depression and anxiety over the years. She displays many
characteristics of individuals with a personality
disorder. She is an angry person who is most likely to
exhibit her anger in passive-aggressive ways. She clearly
has the ability to act out this aggression and most
recently displayed this in the assault charge she received
in jail. Ms. McGhee tends to somaticize her psychological
problems and has difficulty trusting and disclosing to
others. This makes prognosis for traditional therapy
guarded. She will probably continue to need medication in
prison.".
In assessing and considering all the above information
with regard to the issue of whether to grant defendant's
Motion for Judicial Release, this Court refers back to
what was said to the defendant at the time of her
imposition of sentence. And that is whether the Court
feels that there has been a high enough consequence for
the two deaths and destruction that was the result of her
actions. The answer to that question is no. The court
cannot in good conscience let the defendant out of prison
at this point in time.
This court realizes that the defendant may feel as though
there is nothing more she can do to impress the Court, and
so what is the point in continuing her admirable conduct
while in the institution. The answer is that this Court
may, at some juncture, feel that release short of 15 years
may be appropriate. And again this Court will first look
to how the defendant has conducted herself while at the
institution. Her positive conduct will only increase her
chances of such a motion being granted. Negative conduct
will only lessen the chances of her motion being granted.
Therefore this Court would hope that she continues as she
has these past few years.
Defendants Motion for Judicial Release is found not well
taken and is DENIED.

Defendant again filed a Motion for Judicial Release, the
latest being on August 24, 2022. The State of Ohio on
September 1, 2022, filed a Memorandum in Opposition for
Judicial Release. However, the State of Ohio, pursuant to
the plea agreement made on April 7, 2014, had agreed not
to file an objection when defendant petitions the Court
for judicial release. As such, this Court will not take
into account and will disregard the State's opposition of
September 1, 2022.
This Court has reviewed defendant's Motion for Judicial
Release as well as her correspondences sent to the Court
which pre-date the filing of her motion. The Court read
with interest the missive titled "Shedding our Skin".
Additionally, this Court has reread its Order of May 24,
2021, and adopts its reasoning and findings. Because
(primarily) of the two deaths that occurred as a result of
defendant's participation in the aggravated arson that
lead to the two convictions for involuntary manslaughter,
this Court is not prepared to grant judicial release at
this time.
The defendant is again urged to continue with her positive
conduct and development. This Court is not saying that
early release will never be granted. Just that the time is
not right at present.
Therefore, defendant's Motion for Judicial Release is
found not well taken and is Denied.
